Agreement to these terms
These Terms of Service ("Terms") govern your access to and use of northspire.com and the related services we provide (the "Services"). By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy.
If you do not agree with any part of these Terms, please do not use the Services. We may also publish supplemental terms for specific features; where they apply, those supplemental terms form part of this agreement.
These Terms constitute a binding agreement between you and Northspire. Please read them carefully and keep a copy for your records.
Definitions
"Northspire", "we", "us", and "our" refer to the Northspire group of companies. "You" and "your" refer to the individual or entity using the Services.
"Content" means any text, images, listings, data, and other materials made available through the Services. "User Content" means anything you submit, post, or transmit to us or through the Services.
"Listings" means property information published on the Services, including descriptions, imagery, pricing, and availability. Terms defined elsewhere in this agreement carry the meaning given at that point.
Acceptable use
You agree to use the Services only for lawful purposes and in accordance with these Terms. You will not use the Services in any way that could damage, disable, overburden, or impair them, or interfere with another party's use.
You will not attempt to gain unauthorised access to any part of the Services, scrape or harvest data, introduce malicious code, or use automated systems to access the Services except as permitted by our published interfaces.
Property listings and information
Listings and market information are provided for general informational purposes. While we take care to keep them accurate, properties, prices, and availability change frequently and may contain errors or omissions.
Nothing on the Services constitutes an offer, solicitation, or guarantee regarding any property. Square footage, boundaries, taxes, and other figures are estimates that must be independently verified before you rely on them.
All transactions are subject to separate written agreements, applicable law, and the satisfaction of any stated conditions. We do not guarantee that any property shown will be available or transacted on the terms displayed.
Third-party links and services
The Services may link to or integrate with third-party websites, content, and services that we do not control, such as mapping, analytics, and media providers.
We provide these links and integrations for convenience and do not endorse or assume responsibility for third-party content, products, or practices. Your use of third-party services is governed by their own terms.
Any dealings you have with third parties found through the Services are solely between you and that third party.
Disclaimers
The Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Services will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Content is accurate, complete, or current.
To the maximum extent permitted by law, we disclaim all warranties not expressly stated in these Terms. Some jurisdictions do not allow certain disclaimers, so some of these may not apply to you.
Limitation of liability
To the maximum extent permitted by law, Northspire and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Services.
Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us, if any, for access in the twelve months before the claim, or one hundred US dollars.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, such as for fraud or for death or personal injury caused by negligence.
Governing law and disputes
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. The courts located in New York will have exclusive jurisdiction over any dispute not subject to arbitration.
Before bringing a formal claim, you agree to first contact us and attempt to resolve the dispute informally. Many concerns can be settled quickly this way.
Any claim must be brought within the period permitted by applicable law. If any provision of these Terms is found unenforceable, the remaining provisions will continue in full effect.
Changes to these terms
We may update these Terms from time to time to reflect changes in our Services, the law, or our business. When we do, we will revise the "last updated" date at the top of this page.
Material changes will be communicated more prominently where appropriate, for example by a notice on the site. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
If you do not agree to the updated Terms, you should stop using the Services.
